Who we are

Outcomes Insights (OI) is a market research and consulting firm headquartered in Calabasas, CA. The nature of our business, particularly the facilitation and execution of market research, relies on the routine collection and analysis of data relating to consumers or business professionals who participate in our market research initiatives.

This privacy policy applies to all client and personal data that we collect or use in the course of conducting our business, as well as all client information and research participant data housed at any OI facility or stored on the OI network. This privacy policy applies to anyone who has access to such data and to all services or websites that are offered or provided by OI.

Data We Collect

OI collects or is supplied with data that may include, but is not limited to, the following types of information about you, including some categories of personally identifiable information: (1) your name, IP address, and/or other unique identifier; (2) log files, browser information/type, operating system information, and/or other device information; (3) your image and/or voice recordings captured through photography, video recording, and/or audio recording; (4) contact information such as your email address, phone number, mailing address, and/or postcode; (5) demographic data such as your date of birth, gender, educational background, job title or professional qualifications, state/province and country of residence, and/or other imprecise geographical location data; (6) commercial information such as that relating to products or services you have purchased, obtained, or considered, other purchasing or consuming histories or tendencies, and/or other information relating to your awareness or opinion of products or services; (7) other information that you have consented to our clients, independent contractors, vendors, and/or suppliers processing and sharing with third parties; and/or (8) any other information that may be collected in the course of your interactions with OI, our services, and/or our websites.Please be aware that certain non-personally identifiable information may be considered personally identifiable information if it is combined or combinable with other identifiers in a way that enables you to be identified; the same information may be considered non-personally identifiable if it is taken alone or combined only with other non-personally identifiable information.

Legal Basis for Processing

OI is the data controller, as defined in Article 4 of Regulation (EU) 2016/679 (General Data Protection Regulation), of your data. When we collect or process data relating to consumers and business professionals, we rely on consent as the legal basis to do so. Consent is obtained when you are screening into a specific market research initiative undertaken by OI; before you can participate in such an initiative, the nature and purpose of the data collection is described, and consent is obtained for the processing of your data for one or more specific purposes.

Your Rights

OI recognizes that you may have certain rights with regard to your data under this privacy policy or an applicable statute, regulation, ruling, or law. Specifically, you have a right to (1) access and/or receive a copy of the data we hold about you and information relating to how it is processed; (2) rectify errors in or otherwise update your data; (3) request the deletion of your data from our records; (4) object to how we process your data; (5) withdraw or revoke your consent for the processing of your data; (6) be free from discrimination relating to the exercise of any of your privacy rights; and/or (7) lodge a complaint with your local data protection authority.

OI reserves the right to decline requests that are unreasonably repetitive, that jeopardize the privacy of others, the validation facility, or the interests of justice, and/or where we are otherwise required to retain your personal data by law or other applicable legal process.

California Privacy Rights

OI complies with the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act. If the CCPA applies to your data, this privacy policy provides you with information about your rights and OI’s data collection, use, and disclosure practices.If you are a California consumer, you may submit a complaint or request to exercise the rights afforded to you by this privacy policy or the CCPA by contacting OI at sherry@outins.com or by the methods identified under “Contact Us.” You may also designate an authorized agent to submit, on your behalf, a complaint or request to exercise the rights afforded to you by this privacy policy or the CCPA.

Verification

To protect your data (including personally identifiable information) from unauthorized access, modification, and/or deletion, OI may require you to verify your identity and, if applicable, your status as an authorized agent before we can respond to a received complaint or request to exercise the rights afforded to you by this privacy policy or applicable statute, regulation, ruling, or law. If OI cannot verify your identity and, if applicable, your status as an authorized agent, we will not be able to honor your complaint or request to exercise the rights afforded to you by this privacy policy or applicable statute, regulation, ruling, or law.

Disclosure of Information

Except as set forth in this privacy policy or as specifically authorized by you in the context of your participation in a market research initiative, OI collects data solely for the purpose of facilitating and executing market research and does not disclose research participants’ data to any third parties other than in an anonymized and/or aggregated format.

OI may disclose your data (including personally identifiable information) if we believe in good faith that we are required to do so in order to comply with an applicable statute, regulation, ruling, law, subpoena, search warrant, court or regulatory order, or other valid legal process. We may also be required to disclose your data (including personally identifiable information) in response to a lawful request from a public authority, including to meet national security or law enforcement requirements. Additionally, OI may disclose your data (including personally identifiable information) when we have reason to believe that disclosure is necessary to detect fraud or to protect the safety and/or security of our employees, the users of our services or websites, our services or websites themselves, or the general public.OI may employ independent contractors, vendors, and/or suppliers to provide specific services and products. In the course of providing such services and products, these contractors, vendors, and/or suppliers may have access to client and personal data that we collect or use in the course of conducting our business, including your personally identifiable information. OI requires that these contractors, vendors, and suppliers agree (1) to maintain the confidentiality and security of any data to which they are exposed and (2) to not use such data for any purpose other than the provision of services or products to OI.

Security and Data Retention

OI takes precautions to protect the security of all client and personal data that we collect or use in the course of conducting our business, as well as all client information and research participant data housed at any OI facility or stored on the OI network. We implement commercially reasonable technical, administrative, and organizational measures to protect data both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or destruction.

However, neither people nor security systems are foolproof, including encryption systems. Moreover, people can commit intentional crimes, make mistakes, or fail to follow policies. If applicable law imposes any duty to protect your data (including personally identifiable information) that cannot be disclaimed, you agree that intentional misconduct will be the standard used to evaluate our compliance with that duty; any duty to protect your data (including personally identifiable information) that can be disclaimed is hereby disclaimed.OI will retain your data (including personally identifiable information) only for as long as that data is needed to complete the market research initiative or, as the case may be, series of initiatives for which it was collected or for other legitimate business purposes such as resolving disputes, safety and security, or complying with our legal obligations. If there is any conflict between the terms of this privacy policy and a data retention statement specific to the market research initiative in which you participated or are currently participating, the initiative-specific data retention statement shall govern.

International Users

All client and personal data that we collect or use in the course of conducting our business, as well as all client information and research participant data housed at any OI facility or stored on the OI network will be processed and store at our facilities and on our servers in the United States. By participating in any of OI’s market research initiatives, you acknowledge that you understand and accept that your data will be processed and stored in the United States.

Data Privacy Framework Compliance

OI complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF), as set forth by the U.S. Department of Commerce. OI has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the EU/EEA, the UK (and/or, as applicable, Gibraltar), or Switzerland in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles, the Principles shall govern.

Additionally, the Federal Trade Commission has jurisdiction over OI’s compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF.

Complaint Resolution

In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, OI commits to resolve DPF Principles-related complaints about our collection and use of your personal information. EU, UK, and Swiss individuals with inquiries or complaints regarding our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, or the Swiss-U.S. DPF, should first contact OI at sherry@outins.com

You may bring an inquiry or complaint directly to OI at any time and at no cost to you; OI will respond within 45 calendar days. If you submit a complaint to a data protection authority in the EU/EEA, the UK (and/or, as applicable, Gibraltar), or Switzerland, the U.S. Department of Commerce’s International Trade Administration has committed to receive, review and undertake best efforts to facilitate resolution of the complaint and to respond to the relevant data protection authority within 90 days.

Insights Association Independent Recourse Mechanism

In compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF, OI commits to refer unresolved complaints concerning our handling of personal data received in reliance on the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF to the Insights Association Independent Recourse Mechanism, an alternative dispute resolution provider based in the United States.
